Lake Erie is Not A Toilet (But The Supreme Court Most Certainly Is)

 

It's a brave new world... One where a woman in the state of Texas no longer has control over her own body. I touched upon the threats against a woman's right to choose in my piece A Matter of Control. It was written about the influence Brett Kavanagh could have on the Supreme Court in regards to Roe v. Wade. Was I prescient or not?

And now a look at how we're all being "controlled" in a different way... Controlled by the abuse of our natural resources such as our drinking water. Lake Erie is perhaps the biggest poster child of neglected gems of nature--and so easily ignored.

It's not everyday that a world class professional golf tournament comes to your town. When it happens, you have to make the most of it. 

The city of Toledo was fine with hosting a super spreader event during the COVID-19 pandemic, so they opened the proverbial doors to the LPGA's Solheim Cup, along with the tens of thousands of fans it attracts. 

Golf fans who don't believe in wearing face masks I couldn't help but notice.  In return, the fans didn't take much notice of our lovely banner as they hurried past us to enter the private country club.

The Lake Erie Advocates (formerly known as the Advocates for a Clean Lake Erie or ACLE) raised a large sum of money to put up billboards throughout the city and also to have two large banner signs printed to promote the message of how Toledoans are tired of their drinking water being put at risk by the toxins caused by blue-green algal blooms. Can you imagine not wanting massive amounts of animal wastes from large-scale factory "farms" (or CAFOs) flowing into the streams and rivers and then into Lake Erie, the source of the Toledo area's drinking water as well as 11 million+ other human beings living along its shores?

So the brave activists of LEA took position with two large banners outside the front gates of the Inverness Golf Club. An estimated 100,000 visitors were predicted to come into town for the week-long golfing extravaganza. Surely the banners would be seen and the message understood, right?

But, like I said, the predominantly upper-middle class white golf fans from out-of-town didn't seem to be too bothered about poisonous blue-green algal blooms on Lake Erie. Some of the bored looks I caught from passers-by unfortunately only reinforced the stereotype of the rich white suburbanite who lives in a "golden bubble"of affluence (not effluence), choosing to remain happily oblivious to the environmental harm their mega-consumption of meat causes. 

I'm certain they drink nothing but bottled water whenever they come into an area like Toledo. Well, either that or champagne.

The morning's activism wasn't a total loss. I did meet and chatted with a very nice fellow activist. Harold told me that he had attended every day of the Solheim Cup so far (since the beginning of the week) proudly holding his Black Lives Matter sign. His upbeat attitude and energy was a real inspiration. As he stood outside the front gates of the venue, I noticed he generally received good responses to his sign. Only one sour-faced woman stopped and scolded him with a "Shame on you--it's All Lives Matter!" taunt. I returned her taunt with a short explanation that I'm sure she didn't listen to, but at least I tried to set her straight. Harold just smiled at her. I'm sure he's heard it all before and takes it in stride.

In all fairness, I'm not a golf fan (or of any sport really). I wasn't even sure this location or event was the best place for banners dealing with such a serious topic as water pollution, saving our beloved Great Lake, or animals' rights. But the enthusiasm of activists like Harold who show up day after day gives me hope that maybe some of our message might get through to the crowds of well-to-do golf lovers. Perhaps some will even do a quick Google search about what we meant by factory farms and why there was a glass of "green Kool-Aid" on our banners. (It's a glass of slimy blue-green algae-tainted water actually. Yum.)

I try to keep a positive attitude, but it is hard when you see so many people not wearing masks during a deadly pandemic rushing past you while trying not to make eye contact (or banner contact). If a person doesn't care about taking precautions to keep his neighbor safe (by wearing a mask during a pandemic at a crowded sports event), then would they really care about keeping our water clean and shutting down CAFOs? Do they care at all about Lake Erie except as a possible place for their next yachting adventure? It remains to be seen.

No matter how much the golf fans hide behind their red, white and blue outfits, I-phones, and Rolex watches, it won't stop those who care about our shared environment and their neighbors' health from trying to get the word out. The Lake Erie Advocates know time is running out, and they're not giving up. 

We can't keep dumping massive amounts of animal poop into one of the largest bodies of fresh water in the world and expect to get away with it. An increasingly warming climate is only enabling algae blooms to explode across the lake surface. Human beings are turning Lake Erie into a massive toilet, one that we might find is impossible to clean someday. 

Take that warning and flush it down your golf club bags, fans!

Texas' 6-Week Abortion Ban & Bounty has gone into effect.

Extreme anti-abortion lawmakers, led by Greg Abbott have passed one of the most extreme abortion bans in the country (TX SB8). Texas SB8 is a 6-week abortion ban and puts in place a vigilante bounty in place to criminalize those who help or intend to help anyone obtain an abortion outside 6 weeks. As a Texan, let me tell you right now that Texas is not okay. This will hurt people in need of abortion AND ALSO those that support them, young activists, abortion providers, and potentially anyone that speaks out publicly to support people who need abortions in the state.  Most people do not even know they are pregnant until they are at least 6 weeks! Only about 10-15% of abortions happen before 6 weeks. That means “6 week bans” are effectively total abortion bans. The addition of incentivizing vigilantes to “turn in” people who help or intend to help someone get an abortion outside of the 6 week period is extreme violence. This law gives anyone - a neighbor, distant relative, abusive partner, or even a stranger from out of state — the ability to sue someone for having an abortion in civil court AND collect $10,000 for each successful claim. This is one of the most heinous anti-abortion laws in history, it will cause extreme harm to Black, Latinx, Indigenous, low-income, young and rural Texans who already face tons of barriers to accessing abortion. Texans deserve better.

In this critical moment, we need the support of people across the country who believe that people should be able to get the healthcare they need without shame, unnecessary restrictions, or outside interference. Our so-called "Environmental Protection Agency" does everything but protect us and our environment. It allows corporations to dump their chemical wastes wherever they like, whenever they like essentially at the cost of cutting a Congress-member a campaign check. Factory farms are allowed to cage animals into pens for the duration of their meager existences--and then they make sure there are laws outlawing the filming of these deplorable conditions. To top it all off they dump the "manure ponds" from their feedlots into the fields and drainage areas of our rivers and lakes--the same rivers and lakes where we take our drinking water. Cancer is on the rise and toxic blue-green algae blooms are practically an everyday occurrence. So, here's the thing--

We know what is killing us. Why do we let them do this to us?

Another day--another mass murder taking place in the good ol' US of A. It seems Americans have become immune from the onslaught of violence wrought by the gun manufacturing industry. If a classroom of elementary school students dead on the floor isn't enough to start a weapons buy-back program in our cities and the enactment of sensible gun laws nationwide, then what does it take? We have shootings in schools, churches, shopping malls and concerts. We have shootings in synagogues, mosques and parks. We have shootings at festivals, weddings and birthdays. About the only place and time we don't seem to have any mass shooting is in our statehouses and at the Capitol building in Washington D.C. when they're in session. Perhaps that's intentional?

We know who is killing us. Why do we let them do this to us?

Bernie Sanders proposes Medicare for All and ending student loan debt. Immediately, the mainstream media propaganda machine swings into action to paint him as a pie-in-the-sky idealist or a cranky old man who, surprisingly enough, can still run marathons. Yet the vast majority of Americans are desperate for his kind of leadership and these kinds of programs. The broadcast networks and the party apparatus will undoubtedly force him out of the race for the presidency once again. The corrupt establishment will do anything to convince us to vote against our best interests. They will tell us that we have no choice--it's either "sh*t sandwich red" or "sh*t sandwich blue." Pick your poison and choke on it.

We know the system is killing us. Why do we let them do this to us?

There are enough natural predators in the world we should be wary of--and a few extra man-made ones in the form of climate crisis-induced super hurricanes and fracking earthquakes. Why do we allow the continued burning of fossil fuels to add energy to the already coming climate catastrophe? Why doesn't our government encourage the development of green energy and mass transit? Why can't we just keep the oil in the ground so we can keep our planet at a comfortable average temp instead of turning the Earth's surface into a broiler?

We know the Big Oil companies are killing us. Why do we let them do this to us?

Answers aren't always easily discerned--but apathy is. We let them do these things to us because we can't be bothered to care about what happens to us. We don't give a rat's backside about our future. It's like we think we deserve to be treated like sh*t. Maybe we do. But not all of us on this spinning globe are pieces of sh*t. So wake the hell up and give a sh*t about them. Ask the hard questions and demand straight answers of the EPA, of the system, of Big Oil, of our elected representatives. And take action.

The Global Climate Strike week is scheduled from September 20 - 27 and is dedicated to climate actions worldwide while the United Nations is in session discussing the climate catastrophe. Extinction Rebellion and the Movement for a People's Party are planning a shutdown of Washington, DC on September 23. Millions of others in thousands of cities will do similarly.

Be there. No excuses.

Let's don't allow them to continue screwing us. Let's take our destiny back. Let's save the world and its people.

Anti-Rights of Nature Provision in Budget Bill Authored by Ohio Chamber of Commerce, Handed to State Representative

Columbus, OH: An email exchange between the Ohio Chamber of Commerce and the office of Ohio Representative James Hoops has been made public after a records request by a board member of the Ohio Community Rights Network. 

The emails reveal Zachary Frymier, Director of Energy and Environmental Policy for the Ohio Chamber of Commerce (who has since been promoted to State Government Affairs Manager for American Electric Power), expressing concerns about the Lake Erie Bill of Rights and requesting language revoking legal standing for nature and ecosystems be added to the Ohio budget.  

“We have some language that we’d request be considered for the budget. Though obviously it would have to be submitted after tomorrow’s deadline we’d still like to have a conversation,” 

Legislative services commission staff questioned the necessity of the language. Frymier defended the language, to Hoops’ legislative aide, arguing the “language in this amendment stating that [nature and ecosystems] do not have standing is essential to what we’re trying to accomplish. If we could get that added I would be very grateful,” citing the passage of the Lake Erie Bill of Rights in Toledo as his reason.

 

“The Ohio Chamber of Commerce is rewriting Ohio law, handing it off to supposed ‘representatives of the people,’ in order to try to ban a people’s movement. But Rights of Nature is a movement whose time has come. The genie is out of the bottle, and not the state, not the courts, and certainly not the Ohio Chamber of Commerce can stop it. All that is uncertain, is which side of history those in power will be on,” said Toledo organizer Bryan Twitchell. 

 

”These emails prove what the Ohio Community Rights Network has been trying to educate communities about for the past seven years,” stated Tish O’Dell, an Ohio community rights organizer. “Industry and government are colluding to make sure laws are written and passed in the best interest of corporations. Yet people continue to obediently follow these laws that have been written at the expense of people and nature.  The people of Ohio are the only ones who can put a stop to this.”

The 2600+ page budget bill is overwhelmed with non-budgetary provisions in violation of the Ohio Constitution’s single-subject provision. The government violates the constitution, misses deadlines, and allows corporate lobbyists to write it’s laws. But rather than the new budget, it is the Lake Erie Bill of Rights that is under threat for being unconstitutional.

Ohio residents are advancing Community Rights as part of the broader Community Rights Movement building across the United States, where other localities are advancing similar measures to establish and protect their rights to a healthy climate, clean air and water, and the right to local community self-government.

Innocent people in St. Louis are forced to pay $300, plus $10 a day, to be monitored by police before they even get a trial. We're organizing to fight this, and we want you to join us.

Imagine paying $10 a day to be monitored by the police.

Hundreds of people in St. Louis are forced to do this. For these innocent people awaiting trial, electronic monitoring bracelets cost them $300 up front, $10 per day, plus a $50 installation fee. People often have to start second jobs, sell TVs and laptops, or take kids out of childcare just to pay these fees.¹

And all of this money goes to a private company Eastern Missouri Alternative Sentencing Services (EMASS). This company is profiting off of innocent, low-income Black people under the facade of offering “alternatives” to money bail.
The St. Louis court system's business partnership with EMASS is undermining our work to transform criminal justice, and we won’t stand for it. We’re training community members in St. Louis as Court Watchers so we can collect proof of the electronic monitoring crisis and force lawmakers to confront it. 

Our program is scheduled to run through November, but we already know it will take more time to win. Will you donate $5 so we can continue our Court Watch program to expose this blatant exploitation of innocent Black people?
Electronic monitoring puts people in an electronic cage. If you’re wearing an EMASS electronic ankle bracelet, you have to charge it for an hour and a half every day while it’s still on your leg, making it difficult to work full-time jobs or travel for extended amounts of time. In a 2011 survey, 22% of people reported being fired from a job because of their ankle bracelets.² And that’s if they’ll even hire you in the first place with a bulky bracelet in plain view. Over 200 people in St. Louis were forced to wear these bracelets last year.¹

To push back, we need the data to prove how this is impacting Black people in St. Louis. Since this information isn’t easily available to the public, we’re gathering it ourselves. So far, we’ve trained over 30 St. Louis community members in our Court Watch program: they attend hearings and take notes on every decisions judges make, including when people are put on electronic monitors.

In November, we’ll be releasing a public report of our findings, which will:

• Ensure activists and lawmakers in St. Louis have statistics about the courts to help them back up their campaigns to end electronic monitoring and other racist practices
• Give us the data we need to push Prosecuting Attorney Wesley Bell to call on judges to reject electronic cages, holding him to his campaign promise of transforming criminal justice in St. Louis County
• Show judges in St. Louis County that the public is watching them, and that we will hold them accountable if they continue to target low-income Black communities

Our work has already uncovered some alarming patterns. Different judges are inconsistent, some assigning electronic monitors all the time while others rarely do. Some waive the monitor fees, others don’t. Some issue arrest warrants if people don’t pay their debt to EMASS, others turn their head.¹ These choices are all in the hands of individual judges who can only be held accountable if people know what they’re doing.

Campaign Finance Report Sheds Light on Corrupt Corporate Influence Against the Lake Erie Bill of Rights: Report Reveals True Election Meddlers and Outsiders

Toledo, OH: Yesterday (April 5), the post-election campaign finance reports from the February 2019 Special Election revealed that out-of-state opponents of the Lake Erie Bill of Rights (LEBOR) spent almost 50 times as much as Toledoans for Safe Water, the group trying to protect Lake Erie. Toledo Jobs and Growth Coalition, which formed to oppose the LEBOR, led a well-funded campaign against the citizens initiative during the special election. Nevertheless, more than 61 percent of Toledo voters voted in favor of Lake Erie. 

BP Corporation North America, Inc., based in Houston, Texas, is listed as the sole monetary donor to the anti-LEBOR campaign, donating $302,000 with a wire transfer on February 12, 2019. Toledoans for Safe Water spent a total of $5,899.57 to advance the LEBOR. 

Toledo Jobs and Growth Coalition list campaign payments to Yellowstone Associates for consulting and New Troy Strategies for targeted direct mail, phone calls, radio ads, and text messages. Both organizations are based in Virginia and registered to Mary Cheney, daughter of former Vice President Dick Cheney, according to the Virginia Secretary of State website. 

“The time has come for corporate-owned politics to take a backseat to the citizen-led efforts and movements for change. We want to be the ones who influence and shape our communities to reflect our values and protection for the city we call home,” stated LEBOR organizer Julian Mack. 

Although voters in Toledo approved the Lake Erie Bill of Rights in February, this David vs. Goliath battle continues in the courts. Drewes Farms Partnership, another outside interest, sued the city only 12 hours after the passage of the law by Toledo voters. The City of Toledo agreed to a preliminary injunction against enforcing the Lake Erie Bill of Rights.

“Lake Erie is the lifeblood of our community. Without a healthy lake, we the people of Toledo, not Columbus or Virginia, will suffer the consequences of health problems and economic loss. LEBOR shows how people can and should address the democracy problem that creates and fosters the major environmental issues we have been powerless to stop. These campaign finance reports, plus the lawsuit filed by another large corporate entity reveal the system and structure that has to be changed if a livable future in Toledo will exist at all,” commented Bryan Twitchell, LEBOR organizer.

The Real "Out of Town Extremists"

Yesterday was the deadline to submit campaign finance reports disclosing how much money was raised and spent on the February 26 special election in Toledo. This was Toledo's FIRST opportunity to see who the mysterious "Toledo Coalition for Jobs and Growth" was - and the results are interesting.

It turns out the "Toledo Coalition for Jobs and Growth" -- the entity behind the flood of radio commercials alleging that our group, Toledoans for Safe Water, was made up of "out of town extremists" -- was, in fact, the only entity made up of out of town extremists.

This entity is neither from Toledo nor even a coalition; it was BP North America out of Houston, Texas - and they spent $302,000 pouring lies into the heads of unsuspecting Toledoans about the Lake Erie Bill of Rights. And, in spite of that, they still lost.

It's nice to know that sometimes, democracy still works. The Lake Erie Bill of Rights passed with a landslide 61% approval in spite of these fake ads, and two of our organizers are heading to New York City next month to give a speech about the LEBOR in front of the United Nations.

Still, our law is battling for its life in the courts, where high-powered lawyers are hard at work trying to make sure large corporations can remain unaccountable for the pollution they dump in our drinking water. The fight continues.

I'm proud to know that our scrappy grassroots group, Toledoans for Safe Water, managed to beat a large multinational corporation in an election despite being outgunned 50 to 1 in fundraising. This just goes to show the power of committed citizens working together to fight for change.

Once again, Trump’s executive orders expanding his poisonous fossil fuel agenda fail in court -- this time, drilling in virtually the entire Atlantic and Arctic oceans.

We can’t rely on the courts to strike down every bad idea coming from Trump. We, the people, need to seize action.

Sign our Keystone XL pledge of resistance.

Within just a couple of hours of each other, Trump signed an executive order supposed to expedite construction of the Keystone XL pipeline, after his prior executive order had been stricken by a court; and, separately, a judge struck down a Trump executive order revoking a sweeping ban on oil and gas drilling in the Atlantic and Arctic oceans.

You might think that we can simply lather, rinse, and repeat judges striking down everything illegal done by this corrupt administration. But you know that with Mitch McConnell packing the courts, we can’t count on judges to save us. We, the people need to stand up. We must resist every single time Trump tries to resurrect this zombie pipeline.

The pipeline will not only damage the environment but residents along the pipeline route also don’t want it! That’s why I’m writing to implore you to sign the pledge. The ask is simple:

"I pledge, if necessary, to join others in my community, and engage in acts of dignified, peaceful civil disobedience that could result in my arrest in order to send the message to President Trump and his administration that we will not permit the construction of the Keystone XL or other climate-killing pipelines."
